By Using the Services, you accept these Terms of Service.
Please read these Terms of Service carefully and ensure that you understand them before using the Services. These Terms of Service, together with any other documents referred to herein, set out the terms of use governing your engagement with The Tutoring Club and the Services. You may wish to keep a copy of these Terms of Service for your future reference.
These Terms of Service were last updated in July 2025.
Your agreement to comply with these Terms of Service is indicated by your use of the Services. If you do not agree to these Terms of Service, you must stop using the Services immediately.

1. Information about us
In these Terms of Service, unless the context otherwise requires, the following expressions have the following meanings:
- “Content” means any and all text, images, audio, video, scripts, code, software, databases, and any other form of information capable of being stored on a computer that appears on, or forms part of, the Services; and
- “Services” means the online tutoring sessions (either live or recorded sessions) offered by tutors affiliated with The Tutoring Club; and
- “We/Us/Our” means The Tutoring Club, a Limited Company registered at 195 Arthur Road, Windsor, England, SL4 1RZ

4. Access to The Tutoring Club's services
4.1. Service cost
Access to Services are based on the price list as provided at [https://thetutoringclub.com/pricing], which may be updated from time to time.
4.2. Access arrangements
It is your responsibility to make appropriate arrangements in order to access The Tutoring Club’s Services.
4.3. Access timings
Access to Services are provided on an “as is” and on an “as available” basis. We may suspend or discontinue the Services at our discretion. We do not guarantee that the Services will always be available or that access to the Services will be uninterrupted. If We suspend or discontinue the Services (or any part of it), We will try to provide you reasonable notice of the suspension and discontinuation.
4.4. Rescheduling and cancellations
You can reschedule or cancel the Services with advanced notice. You will need to provide a minimum of [24 hours'] notice for cancellation or rescheduling of the Services to be eligible for a full refund. We expect Our tutors to have a lesson plan at least [24 hours] before the Services are delivered, so We recommend you inform the individual tutor for any rescheduling or cancellation of the Services at the earliest possible to avoid disappointment.
4.5. Cooling-off period (Right to Cancel)
If you are a consumer residing in the United Kingdom, you have the right to cancel the Services within 14 days of purchasing the Services from Us without providing any reason.
The cancellation period will expire 14 days after the date on which you purchased the Services from Us.
To exercise your right to cancel the Services, you must contact Us clearly in writing (via email or letter) and state your intention to cancel the Services.
If you cancel within the 14-day period and no Services have been delivered to you, you will receive a full refund of any amounts paid.
If you request that Services begin during the 14-day period, you acknowledge and agree that you will be required to pay for any Services already provided up to the point of cancellation.
5. Changes to The Tutoring Club's services
We may alter and update the Services (or any part of it) at any time.
6. Changes to these terms of service
We may alter these Terms of Service at any time.
Your use of the Services constitutes your acceptance of these Terms of Service. We may change these Terms of Services by posting the revised version on Our website at least 14 days before they become effective. Consequently, any changes made to these Terms of Service will apply to your continued use of the Services and shall apply the first time you use the Services after the changes have become effective. You are therefore advised to check Our website from time to time for any revisions to the Terms of Service.

7. The Tutoring Club's Intellectual Property

All intellectual property rights including the copyright in the Content included as part of the Services belong to or have been licensed by Us, unless specifically labelled otherwise.
7.2. What you can and cannot access/download
You may access, view, and use Services in a web browser (including any web browsing capability built into a mobile device). You may not download (except downloads for caching which occur automatically) or copy the Services or any part of the Services.
You may print one copy and download extracts of any page(s) of the Content from the Services solely for non-commercial personal use.
7.3. Content modification
You may not modify any of the printed copies of the Content or downloaded extracts in any manner except in the case of non-commercial personal use.
Images, video, audio, or any other Content downloaded from the Services must not be used separately from accompanying text.

You must not use any logos or trademarks displayed as part of the Content on the Services without Our express written permission.
You must not frame or embed the Services on another website without Our express written permission.
You may not link to the Services from any website whose primary content violates applicable laws or regulations; is obscene, pornographic, defamatory, libellous, threatening, harassing, or invasive of privacy; promotes violence, terrorism, extremism, or illegal activities; is discriminatory based on race, gender, religion, nationality, disability, sexual orientation, or other protected characteristics; infringes third-party intellectual property rights or other proprietary rights; contains malware, viruses, or other harmful code; or that we reasonably determine to be inconsistent with our brand values or likely to harm our reputation, and we reserve the right to request removal of any such link and to block access from linking sites that breach this provision

If you are a business user (i.e. you are using the Services in the course of business or for commercial purposes), to the fullest extent permissible by law, We accept no liability for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) the Services or the use of or reliance upon any Content included on the Services.

12. Viruses, malware, and security
12.1. Our actions
We exercise reasonable skill and care to ensure that the Services are secure and free from viruses and malware; however, We do not guarantee the security of Our Services.
You are responsible for protecting your hardware, software, data, and other material from viruses, malware, and other internet security risks.
You must not introduce, transmit, or attempt to introduce viruses, malware, trojans, worms or any other material that is malicious, technologically harmful or designed to damage, disrupt, or gain unauthorised access to the Services or Our systems.
12.2. Unauthorised access
You must not attempt to gain unauthorised access to any part of the Services or Our systems, servers, databases, networks or any connected infrastructure on which the Services are stored, or any other server, computer, or database connected to Services.
12.3. Cyber attacks
You must not attack, disrupt, or attempt to overload the Services through denial-of-service attacks, distributed denial of service attacks, flooding, spamming, or any other means that may impair the availability or performance of the Services.

Breaching of the provisions of parts 13.2 to 13.4 of these Terms of Service may constitute a criminal offence under the Computer Misuse Act 1990 and will result in immediate termination of your access to the Services. Any and all such breaches will be reported to the relevant law enforcement authorities, and We will cooperate fully with any investigation initiated by those authorities, including disclosing your identity if required by the authorities.

13.1. Use The Services in a lawful manner
- You must ensure that your use of the Services complies fully with any and all local, national, or international laws and regulations that apply;
- You must not use the Services in any way, or for any purpose, that is unlawful or fraudulent; and
- You must not use the Services to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software, or data of any kind.
13.2. Breaching The Tutoring Club’s terms of service
If you fail to comply with the provisions of this Part 14, you will be in breach of these Terms of Services, We may take one or more of the following actions in response:
(a) Issue you with a written warning;
(b) Suspend or terminate your right to use the Services;
(c) Issue you with a written warning;
(d) Take further legal action against you, as appropriate;
(e) Disclose such information to law enforcement authorities as required by such authorities in relation to any investigation.
13.3 Our exclusion of liability for actions taken in response to breach
We hereby disclaim any and all liability arising from any actions that we may undertake in response to your breach of these Terms of Service, including but not limited to those delineated above in Section 14.2.

We may periodically send important notices to you via email. These notifications may pertain to various matters, including, though not limited to, modifications to Our website, the Services or alterations to these Terms of Service.
15.2. Marketing
We shall not send you marketing emails without your consent. If you do grant consent for marketing communications, you may opt out at any time using the unsubscribe link included in each marketing email. Please note that it may take up to 30 days to process your opt-out request, during which time you may continue to receive emails.

16 Legal framework and jurisdiction
16.1. Our legal relationship
These Terms of Service, along with the relationship between you and The Tutoring Club, whether contractual or otherwise, shall be governed by and construed in accordance with English law.
16.2. Consumer and consumer benefits
If you are a consumer, you will enjoy the benefits of any mandatory legal provisions in your country of residence.
16.3. Consumer disputes
If you are a consumer, any dispute, controversy, legal proceedings, or claim arising between you and The Tutoring Club concerning these Terms of Service or your relationship with The Tutoring Club, whether contractual or otherwise, shall be subject to the jurisdiction of the courts of England~~,~~ Wales, Scotland, or Northern Ireland, depending on your residency. In case you are an international consumer and reside in a different jurisdiction, you may also be entitled to bring proceedings in your local courts.
16.4. Business user
If you are a business user, any dispute, controversy, legal proceedings, or claim arising between you and The Tutoring Club concerning these Terms of Service or your relationship with The Tutoring Club, whether contractual or otherwise, shall be subject to the exclusive jurisdiction of the courts of England and Wales.
